2007 Regular Legislative Session Ends

This is the current NYSCADV Policy update which outlines the bills that impact survivors of domestic violence and their children, that passed during the 2007 New York State Legislative Session.

New Laws Passed

Bill Numbers: A.9244/S.6351 - Permits Victim of Domestic Violence to Terminate a Residential Lease. Signed 8/15/07 - Chapter 616 - Effective 10/1/07

Bill Numbers: A.8679/S.5902 - Enacts provisions relating to offenses involving human trafficking and puts in place services for victims of human trafficking. Signed 6/6/07 - Chapter 74 - Effective 11/1/07

Bill Numbers: A.8854/S.4542 - Adds Criminal Mischief to the list of Crimes that Constitute a Family Offense. Signed 8/15/07 - Chapter 541 - Effective 11/13/07

Bill Numbers: A.618/S.4066 - Provides for the Revocation or Ineligibility for Firearms License or Surrender thereof for Willful Violation of an Order of Protection Involving Physical Injury. Signed 7/3/07 - Chapter 198 - Effective 8/2/07

Bill Numbers: A.7370/S.4020 - Provides that when a Court has directed the Service of an Order of Protection, there shall be No Fee for Service of such Order. Signed 5/21/07 - Chapter 36 - Effective 8/20/07

Bill Numbers: A.8193/S.4538 - Authorizes Criminal Court to issue a Temporary Order of Protection in conjunction with a Securing Order committing defendant to custody and allows Court to prevent defendant from communicating while awaiting trial. Signed 7/3/07 - Chapter 137 - Effective Immediately

Bill Numbers: A.8592/S.4485 - Provides that Certain Persons who Violate Probation or Conditional Discharge shall be Temporarily Detained until brought before Sentencing Court. Signed 7/18/07 - Chapter 377 - Effective Immediately - Sunsets 3/31/10

Bill Numbers: A.11693/S.849 - Provides that any social services worker who receives information in the course of his or her professional or official capacity which gives such social services worker reasonable cause to suspect that a child is an abused child shall report or cause a report to be made regarding such suspected abuse or maltreatment. Signed 8/15/07 - Chapter 513 - Effective 10/14/07

Bill Numbers: A.577/S.2586 - Requires Office of Children & Family Services to inform Surrogates and Family Courts of reports of Child Abuse and Maltreatment that are pending investigation regarding any person nominated to be Guardian as well as individuals 18 years of age or older living in the home. Signed 8/15/07 - Chapter 525 - Effective Immediately

Bill Numbers: A.6847/S.4025 - Provides Limits on the number of Children a Law Guardian may represent in Family Court. Signed 8/28/07 - Chapter 626 - Court Rules due on or before 4/1/08

Bill Numbers: A.7554/S.4704 - Establishes Experimental Program in Erie, Onondaga, Monroe, Nassau, New York, Westchester, Richmond, Kings and Albany counties for Electronic Transmission of Family Court Orders of Protection. Signed 7/18/07 - Chapter 330 - Effective Immediately - Report to Legislature by 4/1/09 - Sunsets 7/1/10

Bill Numbers: A.6610/S.4009 - Establishes Differential Response Programs for Child Assessments or Investigations. Signed 8/1/07 - Chapter 452 - Effective Immediately - Report to the Legislature by 1/1/11 - Sunsets 6/1/11

Bill Numbers: A.7955/S.4041 - Increases the Amount of Emergency Award granted prior to final decision of Crime Victims Board. Signed 7/18/07 - Chapter 318 - Effective Immediately
